The Carroll County Grand Jury met for its first session of 2019 last week, and jurors delivered indictments against all 40 defendants on the docket after hearing the evidence against them.

Among those receiving true bills from the Grand Jury were David Herbert Anderson, 59, of Yuma; Orlando Terrell Olive, 18, of McKenzie; and Joseph Ivan Fallon, 34, of Jackson.

Anderson was indicted for second degree murder, felony possession of a firearm with intent to go armed, unlawful possession of a weapon, criminal trespass, felony stalking, and tampering with evidence.

The Grand Jury indicted Olive on charges of attempted second-degree murder, felony possession of a firearm with intent to go armed, and three counts of aggravated assault.

Joseph Fallon

Joseph Fallon

Fallon’s charges include aggravated kidnapping, contributing to the delinquency of a child, purchasing alcoholic beverages for a child, and concealing, harboring, or hiding a runaway child.

Anderson was arrested back in July for the fatal shooting of 64-year-old Benjamin Cole Birdwell on Birdwell’s property near both Anderson’s and Birdwell’s residences at the intersection of Schoolhouse Road and Rex Lane.

Investigators believe the shooting is related to a longstanding property rights dispute between the two men.

U.S. marshals arrested Olive on December 4 in McKenzie after Olive allegedly shot McKenzie resident Ameshel Teague, 33, on October 14 of last year while she was standing in her driveway with two of her children and others.

Teague, who was shot once in the right hip, identified Olive as the shooter during a December 13 preliminary hearing.

Fallon was arrested on November 1 of last year when police found him with a 13-year-old Buena Vista girl at a convenience store in Gainesville, Florida.

Fallon is accused of making contact with the girl online and then picking her up on two occasions and taking her to his apartment in Jackson.

On the second occasion, Fallon allegedly forced her to have sexual intercourse and then drove off with her to Florida that next day.

The cases of Anderson, Olive, and Fallon will go to trial in Carroll County Circuit Court if plea agreements are not reached beforehand.
